By accessing or using the platform, you unconditionally agree to these Terms.
If you do not agree, you must not use the service.

Absolute No Refund Policy
No refunds, reversals, or credits shall be issued under any circumstances.
This includes but is not limited to service dissatisfaction, delivery failures,
provider downtime, account suspension, regulatory action, or termination.

Buyer Due Diligence Mandatory
The customer acknowledges that the service is fully transparent.
It is the customer's sole responsibility to evaluate, test, and understand the service
before purchase. Post-purchase dissatisfaction shall not constitute grounds for refund.

Third-Party Dependency Disclaimer
RCS is entirely dependent on Google RBM (RCS for Business) and telecom operators
including Jio and Vodafone Idea (VI).
Any outage, suspension, throttling, rejection, policy change, or termination
by these providers shall not create any liability on Afon Group.

Zero-Tolerance Acceptable Use Policy
All usage must strictly comply with Google RBM policies, telecom regulations,
and Indian law. No exceptions, relaxations, or warnings are guaranteed.
Provider instructions shall override all customer agreements.

Prohibited Content & Activities
Spam, phishing, fraud, misleading communication, gambling, adult content,
financial deception, or any illegal activity is strictly prohibited.
Detection will result in immediate suspension without notice.

Wallet Forfeiture
Upon suspension or termination due to policy violation or provider directive,
any unused wallet balance shall be forfeited permanently.
Such balance shall be deemed lapsed and non-recoverable.

Indemnity
The customer agrees to indemnify and hold harmless Afon Group
from any claims, penalties, damages, or legal actions arising from customer usage.

Limitation of Liability
Afon Group shall not be liable for indirect, incidental, special, or consequential damages,
including loss of business, revenue, goodwill, or data.

Legal Actions & Jurisdiction
All disputes shall be governed by Indian law.
Exclusive jurisdiction lies with courts in Mumbai, India.

We do not sell, rent, or trade customer data to third parties.

Collected data may be used for:
Service delivery and optimization
Compliance with telecom and Google RBM policies
Analytics, reporting, and fraud prevention
Custom advertising and promotional activities across platforms such as SEO, SMM, and related digital channels
4. Third-Party Sharing
Data may be shared with Google RBM, Jio, Vodafone Idea (VI),
or regulatory authorities strictly for service delivery, compliance,
and legal obligations.
5. Data Security
We implement reasonable technical and organizational safeguards.
However, no system is completely secure, and absolute security is not guaranteed.
6. Data Retention
Data is retained as long as required for operational, legal,
or compliance purposes and may be retained beyond account termination if required.
Partners
Reseller Addendum
Applicable to all authorized resellers
This addendum applies exclusively to resellers operating on messagingapp.in and supplements the standard Terms & Conditions. It defines the liability chain and operational mandates.
1. Full Responsibility Chain
Resellers are fully responsible for all activities conducted by their end customers.
No separation of liability exists between reseller and end user.
2. Pass-Through Liability
Any compliance issue, provider complaint, or legal notice received by Afon Group
from Google, Jio, VI, or regulators shall be passed down the hierarchy:
Afon Group → Reseller → End User.
3. Mandatory Policy Enforcement
Resellers must enforce Google RBM and telecom policies on their customers.
Failure to do so shall constitute a material breach of agreement.
4. No Shielding or Representation
Resellers shall not represent themselves as independent from Afon Group
for liability, compliance, or provider actions.
5. Suspension Without Notice
Afon Group reserves the right to suspend or terminate reseller accounts
immediately upon detection of risk, misuse, or provider directive.
